AAP vs FDA Lawsuit

May 30, 2019

The Arizona Smoke Free Business Alliance joins multiple other state and federal advocacy organizations and interested companies in filing a letter of intent to intervene in the American Academy of Pediatrics v FDA case in US District Court today.

The court had previously decided to side with the AAP in it’s lawsuit seeking to have FDA reverse the extensions to it’s industry killing PMTA deadlines. Along with other affiliated organizations, and with the legal assistance of Keller and Heckman, LLP, ASFA is joining a motion to intervene on behalf of the US vapor industry.

Similar letters have been filed by JUUL Labs, Inc., John Middleton Co., and ITG Brands. All letters of intent filed express concern with the reduction of the PMTA deadlines and their impact on the industry.

The letter sent by Keller and Heckman is embedded below.
