These findings challenge the prevailing assumption that e-cigarette flavor restrictions offer a straightforward mechanism to reduce youth vaping as a means to protect public health. Specifically, while flavored e-cigarette restrictions may achieve their goal of reducing vaping rates among young adults, consequent increases in smoking rates may offset the expected public health benefits.

Vapers use a wide range of flavors, with 63.1% using a nontobacco flavor. The most common flavor categories were fruit (29.4%) and tobacco (28.7%), followed by mint/menthol (14.4%) and candy (13.5%). Vapers using candy (41.0%, p < .0001) or fruit flavors (26.0%, p = .01) found vaping more satisfying (compared with smoking) than vapers using tobacco flavor (15.5%) and rated vaping as very/extremely enjoyable (fruit: 50.9%; candy: 60.9%) than those using tobacco flavor (39.4%). Among concurrent users, those using fruit (74.6%, p = .04) or candy flavors (81.1%, p = .003) were more likely than tobacco flavor users (63.5%) to vape in order to quit smoking.

The agency did not give manufacturers fair notice of the rules; the agency did not acknowledge or explain its change in position; the agency ignored reasonable and serious reliance interests that manufacturers had in the pre-MDO guidance; and the agency tried to cover up its mistakes with post hoc justifications at oral argument. The contrary views expressed by some of our sister circuits do not address our principal concerns with FDA’s decisionmaking. We therefore hold the agency acted unlawfully.

U.S. Youth Vaping Rates Continue to Show Dramatic Decline
On September 5, 2024, the U.S Food and Drug Administration (“FDA”) and Centers for Diseases Control and Prevention (“CDC”) released data from the 2024 National Youth Tobacco Survey (“NYTS”), which shows the most remarkable decline in youth vaping to date. Specifically, the most recent NYTS, an annual, cross-sectional, web-based survey of U.S. middle school (grades 6-8) and high school (grades 9-12) students, indicates that the number of middle school (“MS”) and high school (“HS”) students reporting use of e-cigarettes or electronic nicotine delivery systems (“ENDS”) has declined to the lowest level in a decade. The 2024 NYTS was conducted among 29,861 HS and MS students from 283 schools between January 22 and May 22, 2024.
